TechNest Solutions ("us", "we", or "our") values the intellectual property rights of individuals and expects our users to uphold these standards. In compliance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we are committed to promptly addressing allegations of copyright infringement occurring through our services, provided these allegations are brought to the attention of our Designated Copyright Agent, detailed in the sample notice below.
DMCA Notice of Alleged Infringement ("Notice")
- 1. Identify the copyrighted work that you believe has been infringed upon, or if there are multiple works, you may list a representative selection of those works.
- 2. Specify the material or link you claim is infringing (or the subject of infringing activity) that needs to be disabled, including at least the URL on the Site or the precise location where the disputed content can be found.
- 3. Include your company affiliation (if relevant), mailing address, phone number, and, if possible, your email address.
- 4. In the body of the Notice, include both of the following declarations:
- * "I hereby affirm that I have a good faith belief that the use of the copyrighted material in dispute is not authorized by the copyright owner, its agent, or under the law (e.g., as a fair use)."
- * "I certify that the information presented in this Notice is correct and, under penalty of perjury, I am the copyright owner, or am authorized to act on behalf of the copyright owner, regarding the exclusive rights that are allegedly infringed."
- 5. Provide your complete legal name along with your electronic or physical signature.

It is important to note that under Section 512(f) of the DMCA, anyone who intentionally misrepresents that material or activity is infringing may face legal consequences.
Counter-Notification
If you feel that your content has been unjustly removed (or access to it disabled), or you have the authorization from the copyright owner or their agent, or you are using the content lawfully, you may submit a counter-notification containing the following information to our Designated Copyright Agent:
- 1. Your physical or electronic signature;
- 2. Identification of the content that was removed or to which access was disabled and where it previously appeared;
- 3. A statement affirming your good faith belief that the content was removed or disabled due to an error or misidentification;
- 4. Your name, mailing address, phone number, and email address, a statement consenting to the jurisdiction of the federal court in Seychelles, and a statement agreeing to accept service of process from the individual who submitted the original notice of alleged infringement.
If our Designated Copyright Agent receives a counter-notice, we may send a copy to the original complainant, informing them that we might restore the removed content or cease disabling it in 10 business days. Unless the copyright owner files a lawsuit seeking a court order against the content provider or user, the removed content may be reinstated or access restored within 10 to 14 business days post-receipt of the counter-notice, at our discretion.
Repeat Infringer Policy
In accordance with the DMCA and other relevant laws, we have implemented a policy that allows for the termination of users deemed to be repeat infringers, at our discretion. Additionally, we may limit access to the Site and/or terminate accounts of any users who violate the intellectual property rights of others, regardless of whether such violations are repeated.
